3.1. Subscription Agreement: BetterCoffee provides Users with coffee subscription services. By subscribing, Users agree to the following:

  • Subscriptions are offered without obligation and can be canceled at any time before a delivery.
  • BetterCoffee reserves the right to select monthly coffee offerings based on its criteria, which may lead to variations in the quantity of coffee per bag.

3.2. No Agency: No agency, partnership, or representation agreement is established between Users and BetterCoffee unless explicitly agreed upon in writing.

Section 4: Limitation of Liability

4.1. Limited Liability: BetterCoffee accepts limited liability for the quality, conformity, security, lawfulness, integrity, or reliability of rights and obligations resulting from agreements.

4.2. Non-Functioning Products: We are not liable for damage resulting from the non- or improper functioning of a Product unless caused by intent or gross negligence.

4.3. Limitation of Liability: Our liability for failure to perform obligations is limited to direct damages directly related to deficiencies attributable to BetterCoffee. Indirect or consequential damages are excluded.

Section 5: Governing Law and Dispute Resolution

5.1. Jurisdiction: All disputes arising from or related to agreements shall be exclusively submitted to the competentΒ German civil court in the location of BetterCoffee, unless legal regulations dictate otherwise.

5.2. Applicable Law:Β German law shall apply to these Terms and any disputes arising from them.

Section 6: Account Creation and Use

6.1. Age Requirement: Users must be at least 18 years old if natural persons.

6.2. Account Creation: Users must create an account following the method described on the Website to use BetterCoffee's services.

6.3. Account Responsibility: Users are responsible for all consequences resulting from using their accounts.

Section 7: Payment and Billing

7.1. Payment Process: Users agree to pay for subscriptions as outlined on our website. Payment methods may include credit cards, Paypal, and others as specified.

7.2. Pricing and Charges: Prices include VAT (unless the buyer is based outside of the EU). Shipping costs are separate and weight-based. BetterCoffee may adjust pricing and shipping costs as needed.
